§5222. Board of directors
A. The commission shall be governed by a board of directors, which shall be solely
responsible for setting the policy and managing the activities of the commission.
B. The board shall be composed of the following members:
(1) One member appointed by the governor who shall serve as chairman.
(2) The commissioner of multimodal commerce in the Department of Transportation
and Development who shall serve as vice chairman.
(3) The secretary of Louisiana Economic Development or his designee.
(4) One member of the House of Representatives appointed by the speaker of the
House of Representatives.
(5) One member of the Senate appointed by the president of the Senate.
(6) Six members appointed by the governor from a list of four nominated
individuals, submitted per port classification by the Port Association of Louisiana, as
follows:
(a) Two members from inland ports.
(b) Two members from coastal ports.
(c) Two members from deepwater ports.
(7) One representative of the Louisiana Railroads Association appointed by the
governor.
(8) One representative of the Louisiana Motor Transport Association appointed by
the governor.
C. Members appointed by the governor pursuant to Paragraphs (B)(6) through (8)
of this Section shall be the executive director of the entity or his designee, subject to Senate
confirmation.
D. A majority of the members of the board shall constitute a quorum for the purpose
of transacting business, and all official actions of the board shall require the favorable vote
of two-thirds of the entire membership of the board.
E. The board shall adopt rules for transacting its business and shall keep an accurate
record of all of its proceedings and official actions. All papers, documents, and records
pertaining to the board shall be filed at the domicile of the board.
F. For purposes of this Chapter, the classification of ports as inland, coastal, and
deepwater shall be in accordance with the Louisiana Legislative Auditor's Informational
Report regarding Louisiana's Public Port System, dated January 31, 2024, and any
subsequent updates or as amended from time to time.
