§3225. State chemist
A. The director of the Louisiana Agricultural Experiment Station of the Louisiana
State University Agricultural Center or his designee shall be the state chemist.
B. The state chemist, or his designee, shall perform the chemical and other analyses
necessary to implement the provisions of this Part and the rules and regulations adopted
under the provisions of this Part. Such analysis shall be performed according to the most
reliable methods available.
C. The state chemist, or his designee, shall establish analytical tolerances for label
claims or guarantees of chemical composition of pesticides and analytical tolerances for
pesticide residues.
D. Each manufacturer who registers a pesticide shall make available to the
commissioner, at no cost to the state, sufficient samples of the pesticides for the enforcement
of this Part.
E. The commissioner shall publish, at least annually, a report of all analyses
performed by the state chemist under the provisions of this Section. The commissioner may
publish such other reports resulting from inspections and analyses by the state chemist as the
commissioner deems appropriate.
F. In all civil and criminal actions, all reports by the state chemist, when certified and
sworn to by him, shall be prima facie evidence of the facts contained therein and shall be
admitted into evidence without further foundation.
