§2.1. Ownership of brine produced incident to oil and gas operations
Unless expressly provided otherwise by contract, brine produced incident to the
production of oil and gas by the person, including operators and producers acting on behalf
of the person, who has the right to drill into and to produce from a pool and to appropriate
the production, either for himself or for others, belongs to such person, regardless of whether
such brine is saved, retained, used, or sold for the purpose of extracting the constituent parts,
minerals, elements, compounds, or substances contained in or dissolved in the brine.
