SUBPART B. APPRAISAL PROCESS
§1807.11. Definitions
The following definitions apply to this Subpart:
(1) "Appraiser" means a person who is qualified to be an appraiser pursuant to the
provisions of R.S. 22:1807.14 and selected by an insurer or a claimant to participate in the
appraisal process.
(2) "Claimant" means a person who makes a first-party claim under a policy of
property insurance.
(3) "Good cause" means any of the following:
(a) Any conflict of interest provided for in R.S. 22:1807.14 or 1807.17.
(b) A lack of independence or inability to competently or promptly carry out the
duties required by this Part.
(c) Any other reasons that would reasonably be expected to impair an appraisal.
(4) "Immediate family" as the term relates to an appraiser or umpire means his
spouse, the parents of his spouse, his parents, his children and their spouses, and his siblings
and their spouses.
(5) "Party" means an insurer or a claimant. "Party" includes employees, contractors,
and other representatives of a party.
(6) "Umpire" means a person who is qualified to be an appraisal umpire pursuant to
the provisions of R.S. 22:1807.17 and selected by the appraisers or a judge to participate in
the appraisal process.
(7) "Umpire selection panel" means a list of potential umpires prepared by the
commissioner for selection of an umpire pursuant to R.S. 22:1807.19.
