§986. Nonapplication to certain policies
A. Nothing in this Subpart shall apply to or affect:
(1) Any policy of workers' compensation insurance or any policy of liability
insurance with or without supplementary expense coverage.
(2) Any policy or contract of reinsurance.
(3) Life insurance, endowment or annuity contracts, or supplemental contracts which
contain only such provisions relating to accident and health insurance as:
(a) Provide additional benefits in case of death or dismemberment by accident.
(b) Operate to safeguard such contracts against lapse, or to give a special surrender
value or special benefit or an annuity in the event that the insured or annuitant shall become
totally and permanently disabled, as defined by the contract or supplemental contract.
(4) Fraternal benefit societies, and nonprofit funeral associations regulated under
other Parts of this Chapter.
B. The provisions of R.S. 22:973, 975, 976, 980, 1021, 1022, 1023, and 1156 shall
not apply to group or blanket health and accident insurance policies, or to group or blanket
policies providing only benefits to cover the cost of legal services and related expenses,
including but not limited to counsel's fees, court costs, investigative fees, and expenses
incurred by counsel in the investigation of matters, their preparation for trial, and trial,
provided that no such policy shall contain any provision relative to notice or proof of loss,
or to the time for paying benefits, or to the time in which suit may be brought upon the
policy, which in the opinion of the commissioner of insurance is less favorable to the
individuals insured than would be permitted by the standard provisions required for
individual health and accident policies, or individual policies to cover legal services, as the
case may be.
