§1006. Reemployment of retirees
A.(1) Any service retiree of the Louisiana School Employees' Retirement System
may be reemployed in any position covered by the system as a full-time, part-time,
temporary, or substitute employee subject to the provisions of this Section.
(2) The employing agency shall transmit monthly, by the fifteenth day after the end
of the month, a report with the name, social security number, and the amount of earnings of
the retiree during the previous month.
(3) For the purposes of this Section, there shall be an annual cost-of-living
adjustment to the average compensation figure used in these computations. This
cost-of-living adjustment shall be based upon and directly reflect the annual percentage
increase or decrease in the Consumer Price Index for the preceding year.
B. If the earnings of the reemployed retiree in any fiscal year are in excess of fifty
percent of average compensation, an amount equal to the amount of the earnings in excess
of fifty percent of average compensation for the fiscal year shall be repaid to the retirement
system, either through direct reimbursement to the system or by suspension of benefits;
however, the repayment amount shall not exceed the amount of retirement benefits received
by the retiree for the fiscal year.
C. Should any employing agency fail to submit the report required by Subsection A
of this Section, the employing agency shall be liable to the retirement system for the
repayment of any overpayments to the retiree by the system.
D. The provisions of this Section shall not apply to any retiree of this system who
retired from service as a bus operator, who returns to active service in a full-time or part-time
position as a bus operator covered by the provisions of this Chapter, and whose employer
chooses to reemploy him pursuant to R.S. 11:1007. The reemployment of such retired bus
operators shall be governed by the provisions of that Section.
