§2546. Littering of waters; definitions; penalties
A. It shall be unlawful for an operator, passenger, crew member, or any
person on board any vessel to intentionally discharge, discard, and permanently
abandon into the waters of the state any type of finished plastic products, including
but not limited to synthetic ropes, fishing nets, and garbage bags, or to intentionally
discharge, discard, and permanently abandon other garbage, including but not limited
to paper products, glass, metal, dunnage, lining, and packing materials.
B. As used in this Section, "vessel" means any boat, barge, or other vehicle
operating in the waters of the state, including all commercial and recreational
watercraft.
C. Any person who violates the provisions of this Section shall be fined not
less than fifty dollars nor more than two hundred dollars for each violation;
subsequent to notification of such violation, each twenty-four hour day the condition
remains uncorrected shall constitute a separate violation.
